Definitions

Rental, Indemnity and Warranties
This Agreement constitutes a contract for the rental of the vehicle. We reserve the right to repossess the vehicle at your expense without prior notice if it is abandoned, misused, or operated in violation of this Agreement or applicable laws. You agree to indemnify and hold harmless Eco Luxe Drive LLC from any claims, liabilities, damages, costs, or attorney fees arising from your use or operation of the vehicle. We make no express or implied warranties regarding the vehicle, including merchantability or fitness for a particular purpose.
Condition and Return of Vehicle
You agree to return the vehicle to our designated rental location on the date and time specified in this Agreement and in the same condition as received, excluding normal wear and tear. If the vehicle is returned after business hours, you remain responsible for its condition until inspected by our team. Any repairs, servicing, or replacement of parts during the rental period must receive prior authorization from Eco Luxe Drive LLC. You are also responsible for monitoring and maintaining proper fluid levels during the rental period.
Responsibility for Damage or Loss
You are responsible for all damage to or loss of the vehicle, including repair expenses, diminished value, loss of use, towing, storage, and administrative fees. If the vehicle is declared a total loss or unrecoverable, you are responsible for its fair market value. Any accident, theft, vandalism, or damage must be reported immediately to both Eco Luxe Drive LLC and local law enforcement authorities.
Breach of Agreement
Prohibited uses of the vehicle include, but are not limited to:
Operation by unauthorized or unlicensed drivers
Driving under the influence of alcohol, drugs, or prohibited substances
Use for unlawful activities, racing, reckless driving, or off-road operation
Towing, overloading, or transporting unsecured passengers, animals, or hazardous materials
Operating the vehicle outside approved geographic areas
Tampering with the odometer or neglecting vehicle maintenance requirements
Violation of any provision of this Agreement constitutes a breach of contract and may result in termination of the rental agreement, repossession of the vehicle, and additional charges. You waive all claims against Eco Luxe Drive LLC related to lawful enforcement actions arising from such violations.
Insurance
You are responsible for damages, injuries, or liabilities caused to third parties during the rental period. Renters must maintain valid auto liability, collision, and comprehensive insurance coverage where required by law. If no applicable coverage exists, Eco Luxe Drive LLC may provide secondary liability protection up to minimum state-required limits where applicable. Optional protection products may be offered at the time of rental and may be accepted or declined by the renter.
Charges
You agree to pay all charges related to the rental, including but not limited to:
Rental fees and mileage charges
Additional driver fees and optional services
Fuel replacement charges if returned with less fuel than provided
Applicable taxes, tolls, citations, penalties, and administrative fees
Late return, recovery, towing, or impound costs
Excessive cleaning or detailing fees
Collection costs, chargebacks, and attorney fees for unpaid balances
Deposit
Eco Luxe Drive LLC reserves the right to apply your security deposit toward unpaid balances, damages, fees, or any other charges incurred under this Agreement.
Your Property
Eco Luxe Drive LLC is not responsible for loss, theft, or damage to personal belongings left inside the vehicle or at our facilities, regardless of the cause.
Modifications
No provision of this Agreement may be modified, waived, or amended unless approved in writing and signed by an authorized representative of Eco Luxe Drive LLC. Rental extensions require prior approval, vehicle inspection, and updated written authorization.
Miscellaneous
Failure to enforce any provision of this Agreement does not constitute a waiver of future enforcement rights. Acceptance of partial payment does not limit our legal remedies under this Agreement. If any portion of this Agreement is deemed unenforceable, the remaining provisions shall remain fully valid and enforceable. Eco Luxe Drive LLC shall not be liable for indirect, incidental, special, or consequential damages arising from the rental or use of the vehicle.
